These Terms of Service ("Terms") govern your access to and use of the Essential City Info application and website (the "Service"), provided by Roberto Galati, a private individual based in Italy, operating Essential City Info. By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. Last updated: 2026-04-25.
1. Acceptance of Terms
By creating an account, accessing or using the Service in any way, you confirm you are at least 16 years old (13 in the US/UK, or the minimum age in your jurisdiction), have legal capacity to enter into a binding contract, and accept these Terms in full. If you use the Service on behalf of an organisation you warrant you are authorised to bind that organisation.
2. Description of the Service
Essential City Info is a free, informational travel-aid application showing geolocated points of interest in Rome (public toilets, drinking fountains, ATMs, ZTL zones, hospitals, embassies, transit, etc.), aggregated from public and open-data sources, plus optional account features (favourites, language preference).
An optional paid "Premium" plan is offered as a one-time annual purchase (currently €2.99 per year, no auto-renewal). Premium unlocks additional features and access to all current and future cities supported by Essential City Info.
The Service does NOT provide legal, medical, emergency, navigation, financial, or governmental services. It is purely informational.
2bis. Payments — Merchant of Record
Our order process for any paid plan is conducted by our online reseller Paddle.com Market Limited ("Paddle"). Paddle is the Merchant of Record for all our paid orders. Paddle handles all payment processing, billing, sales tax/VAT compliance, invoicing, customer service inquiries related to billing, and refunds.
When you purchase a paid plan, your contract for the purchase is concluded with Paddle as the seller of the digital service, while Roberto Galati, a private individual based in Italy, operating Essential City Info remains the provider of the underlying Service. Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms) and Refund Policy (https://www.paddle.com/legal/refund-policy) apply to your purchase in addition to our Refund Policy below.
3. NO WARRANTY — Information provided 'AS IS'
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.
Data such as ZTL hours, pharmacy openings, transit strikes, weather alerts, embassy details, hospital information, and points of interest is sourced from third parties (Roma Capitale, ATAC, Salutelazio, MIT, OpenStreetMap, etc.). Such data may be incomplete, outdated, inaccurate, or temporarily unavailable. ALWAYS verify critical information against the official source before relying on it.
We DO NOT GUARANTEE that the Service will be error-free, secure or uninterrupted, that defects will be corrected, or that any specific result will be achieved through use of the Service.
4. Specific safety disclaimers
EMERGENCIES: in any medical, fire, security or other emergency call the official emergency number (112 in the EU, 911 in the US, or the local equivalent). The Service is NOT an emergency tool and must not be used as a substitute for emergency services.
MEDICAL/HEALTH: hospital and pharmacy information is for orientation only. We do not endorse or vouch for any facility's quality, opening hours or available treatments. Always confirm directly with the facility.
DRIVING / ZTL: ZTL boundaries displayed are indicative, derived from public maps and OpenStreetMap. Roma Capitale does NOT publish ZTL borders as open data. Always check official electronic gates and signage at romamobilita.it before entering. We bear no responsibility for any fines, penalties, towing or other consequences resulting from reliance on ZTL display.
TRANSIT/STRIKES: strike notices are aggregated from the Italian Ministry of Infrastructure (MIT) and may not reflect last-minute changes, partial adherence or local exceptions. Always verify with the operator (ATAC, Trenitalia, etc.) before travelling.
GEOLOCATION: distances and "nearby" results are computed from your declared device position and may be imprecise (especially indoors, underground or in dense urban areas). Use independent navigation tools for actual routing.
EMBASSY/CONSULATE: contact information may change without notice. Always verify on the official ministry of foreign affairs website of the relevant country before travelling or contacting them.
FOOD/WATER (nasoni): public drinking fountains in Rome are regularly tested by the municipal water authority (ACEA). However we cannot guarantee the safety of any specific fountain at any specific time. Use at your own risk.
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM (WHICH FOR FREE USERS IS ZERO), OR (B) FIFTY EUROS (€50).
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for gross negligence, wilful misconduct, fraud, death or personal injury caused by negligence).
6. Indemnification
You agree to indemnify, defend and hold harmless Roberto Galati, a private individual based in Italy, operating Essential City Info, its affiliates, officers, employees and agents from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party (including intellectual property or privacy rights); or (d) any content you submit through the Service.
7. Acceptable use
You agree NOT to: (a) use the Service for any unlawful purpose or in violation of any applicable law; (b) attempt to gain unauthorised access to the Service, our servers, or networks; (c) interfere with or disrupt the Service or servers; (d) probe, scan or test the vulnerability of the Service without prior written permission; (e) use any automated means (bots, scrapers) to access or extract data, except for compliant search-engine crawling; (f) reverse engineer, decompile or disassemble any portion of the Service except as permitted by law; (g) submit false, misleading, defamatory, infringing, obscene or otherwise unlawful content; (h) impersonate any person or misrepresent your affiliation; (i) collect or harvest personal data of other users; (j) use the Service to send spam or unsolicited communications.
We may suspend or terminate your access for any actual or suspected breach, with or without notice, at our sole discretion.
8. Intellectual property
The Service, including its software, design, graphics, text, logos and trademarks (excluding third-party content and open-data), is owned by us or our licensors and is protected by copyright, trademark and other laws.
Open-data we display (e.g. OpenStreetMap, public administration data) remains under its original licence (e.g. ODbL, CC-BY) and we comply with attribution requirements where applicable.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms. All rights not expressly granted are reserved.
9. User-submitted content
Any feedback, report or other content you submit through the Service ("UGC") must be lawful, accurate to the best of your knowledge, non-infringing and non-defamatory. You retain ownership of your UGC but grant us a worldwide, royalty-free, non-exclusive, sublicensable licence to use, reproduce, display, distribute and create derivative works of the UGC for the purpose of operating, improving and promoting the Service.
We may, at our sole discretion, remove, refuse or edit UGC that violates these Terms or applicable law.
10. Third-party services and links
The Service may include links to or integrations with third-party services (e.g. Google Maps, embassy websites, Julia chatbot by Roma Capitale, transport operators). We do not control, endorse or assume responsibility for the content, policies or practices of any third party. Your interactions with such third parties are governed by their respective terms and policies.
11. Suspension and termination
You may stop using the Service or delete your account at any time via the in-app account settings or by writing to support@essentialcityinfo.com.
We reserve the right to suspend or terminate your account or access to the Service, in whole or in part, at any time, with or without cause and with or without notice, including but not limited to in case of breach of these Terms or applicable law.
Provisions that by their nature should survive termination (e.g. limitation of liability, indemnification, intellectual property, governing law) shall survive.
12. Changes to the Service or these Terms
We may modify, suspend or discontinue the Service (in whole or in part) at any time, with or without notice. We may also revise these Terms; the "Last updated" date will reflect the most recent revision. Material changes will be communicated in-app, by email (if you have an account), or via prominent notice on the website. Continued use after the effective date of revised Terms constitutes acceptance.
13. Force majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, strikes, governmental actions, epidemics or pandemics, internet or utility outages, third-party service failures (including hosting providers, data sources, payment processors), or cyber-attacks.
14. Governing law and jurisdiction
These Terms are governed by the laws of Italy, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Italy, except where mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings in your local courts and/or under your local law.

15. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be replaced by a valid one that most closely reflects the original intent.
These Terms (together with the Privacy Policy and Cookie Policy) constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
No waiver of any provision shall be deemed a further or continuing waiver. Failure to enforce any right or provision is not a waiver thereof.
16. Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
